Please read carefully. By purchasing fuel from Smith & Sons Fuels Inc., the customer agrees to be legally bound by the following terms and conditions.
General Agreement
The customer agrees to indemnify and hold harmless Smith & Sons Fuels Inc. and its affiliates from any claims or demands arising out of the use or misuse of our services.
Payment Policy
Payment is due on or before the time of delivery.
Accepted forms of payment: cash, check, ACH, Visa, MasterCard, and Discover.
Smith & Sons Fuels has no control over market pricing and cannot guarantee or predict future prices.
We do not offer price lock-in rates or pre-buy programs.
Cancellations & Order Changes
Cancellations must be made at least 72 hours in advance. Same-day cancellations will still be billed in full.
Changes to your order (fuel amount, payment method, etc.) must be made at least 48 hours in advance.
While we do our best to accommodate changes, the customer remains responsible for the original order amount.
Refunds and fuel pump-outs are not offered.
Debt Collection
If payment is not received at delivery, an invoice will be mailed.
If no payment is received within 10 days, the account will be forwarded to a third-party collection agency.
The customer is responsible for all related late fees, legal fees, and administrative costs associated with the collection of the debt.
Discounts
Veterans: 5¢/gallon discount with proof submitted to smithandsonsfuel@gmail.com
Seniors: 5¢/gallon discount with proof submitted to smithandsonsfuel@gmail.com
Cash Payments: 5¢/gallon discount available when requested at the time of ordering.
Customer-Owned Equipment
Smith & Sons Fuels is not responsible for the condition or maintenance of tanks, whistles, gauges, or fill pipes.
Equipment must be in safe working order before a delivery can be scheduled.
No delivery will be made to tanks with a non-functioning whistle.
We do not provide tank certification, repair, or inspection services.
Liability Disclaimer
Smith & Sons Fuels is not liable for damage, failure, or leakage involving customer-owned tanks or lines.
Customers are advised to ensure their homeowner’s insurance includes coverage for oil-related incidents.

We recommend:
Installing containment barriers under outdoor tanks
Using containment trays under indoor tanks
Considering modern tanks such as Roth-style tanks, which may come with up to a 30-year warranty
Customer Conduct
All customers must treat Smith & Sons employees with respect and professionalism.
Foul language, accusations, and inappropriate behavior will not be tolerated.
Minimum Delivery
Minimum fuel delivery is 100 gallons.
Orders below this minimum are subject to a $20 small load fee to cover delivery costs.
Invoices
Invoices are typically left on or near the door closest to the fill location, unless otherwise requested.
Customers may request invoices via email at no charge. Mailed invoices may incur a small processing fee.
Driveway Maintenance
Customers must maintain driveways and tank access areas in a condition safe for delivery.
Driveways must be sanded, plowed, and navigable for large 2-wheel drive fuel trucks.
Access paths must be shoveled and free of debris. Heavy, full fuel hoses can damage or displace loose items.
Customers are responsible for:
Tow bills if the truck gets stuck
Driver injuries caused by unsafe conditions
Spill damages due to inaccessible or unsafe tanks
A cancellation fee if a driver arrives and is unable to complete the delivery due to unsafe access
Tank Removal
Smith & Sons Fuels does not provide tank removal, pump-outs, or repair services.
Emergency Deliveries
Emergency fuel delivery is available to current customers only.
A $125 emergency fee applies for after-hours requests.
Deliveries typically occur within 1–6 hours, depending on driver availability and weather, and volume of calls coming in that day.
Please ensure a light source is available near the tank to help ensure safe delivery.
Vacation Closures
The business may close for 1–2 weeks during the summer.
Vacation closures will be posted in advance on our Facebook page.
Customers are expected to order in advance to avoid running out during those periods.
Ordering Guidelines
Customers must order fuel at least one week in advance during winter months.
Storms, holidays, or illness may impact delivery schedules.
Customers are responsible for ordering ahead and will be charged for expedited or emergency delivery requests.
Automatic Delivery
Smith & Sons Fuels offers automatic delivery to qualified customers.

Fuel Additives
Fuel Ox and other additives are available upon request for a small fee.
Additives can help prevent gelling in outdoor tanks and improve performance in extreme cold.
HEAP & Assistance Programs
Smith & Sons proudly accepts HEAP, and other fuel assistance payments.
We require written confirmation from the program before delivery can be scheduled.
Questions about eligibility or benefit amounts should be directed to your local DSS or Office for the Aging.
Privacy Policy
Smith & Sons Fuels does not sell or share customer information.
Personal details are used solely for account servicing, delivery scheduling, and direct communication.
